Terms of service

The terms for using Ptasie Domki. Written so that it can be read before signing, rather than after a failure.

Who provides the service
The service is provided by Karol Maj, a sole trader running the Ptasie Domki service. Contact for all matters: kontakt@ptasiedomki.pl.

What the programme is
Ptasie Domki is an app for keeping a nest box registry and writing field inspections. It works in a browser and on a phone, including with no network connection; entries written with no signal reach the server once it returns.
The programme does not replace scientific documentation or filings with nature-protection authorities. It is a record-keeping tool, not the legal basis of anything.

Conclusion of the contract
With an institution — a forest district, a park, a municipality, an organisation — the contract is entered into by the the institution, not a private person. Scope, number of accounts and price follow from a separate offer. These terms form part of it.
With a private person who creates an account themselves, the contract is concluded at the moment the password is set from the link sent to the address given. Such an account is free of charge and covers only that person’s own boxes; it gives no view of anybody else’s registry.

Accounts and roles
There are two ways into the programme, and they are not the same way in.
- An institutional account is created by the coordinator on the institution’s side, and it is they who assign roles and zones. Nobody can add themselves to somebody else’s institution — access to somebody else’s registry cannot depend on who knows the address of the site.
- A private person’s account is created by the person themselves: the login screen has a button labelled Create an account. It lands in the shared “Community” unit and sees only that person’s own boxes. This way in exists for somebody who has hung a box on their own tree and belongs to no institution.
Registration does not ask for a password, and that is not an oversight. The account is created without one and a link for setting it goes to the address given — which makes creating the account at the same time proof that the address is yours. An account with no password set gives access to nothing.
- An account is personal and must not be shared.
- The password is confidential, and a device with a saved session has to be protected like the notebook holding the registry.
- Losing control of an account must be reported at once — we will block it immediately, without waiting for a token to expire.

Obligations of those using the service
- Enter data that is true. An inspection is a record, not a note.
- Do not work around the limits of zones or roles.
- Do not make the locations of protected species’ nests public, exports included.
- Do not test the security of the app without our written consent.

Availability and interruptions
We take care to keep the app available without interruption. Planned work is announced at least three days ahead and carried out outside the breeding season wherever possible.
An outage on our side does not stop work in the field: the app works with no network, and entries wait on the device and send themselves once the service returns. This is not a marketing promise but the way the app is built.

Your data and backups
- The data entered into the app belongs to the institution. We do not use it for our own purposes.
- We make backups once a day and keep them for 30 days.
- At any time you can export everything to CSV — a format every spreadsheet opens. We do not hold anybody by giving them no way out.
- After the contract ends we hand over a full export, and delete the data 30 days after handing it over.

Liability
We are liable for damage caused intentionally or through gross negligence, under the general rules. We are not liable for the consequences of untrue data being entered, for a device lost before synchronising, or for decisions taken solely on the basis of summaries from the app.

Complaints
We accept complaints at kontakt@ptasiedomki.pl. We answer within 14 days. A report is helped by the date, the time and what was on the screen — without those we are searching blind.

Changes to these terms
We give notice of a change 30 days ahead. If the institution does not agree to it, it may terminate the contract before the change takes effect, and we hand over a full export of the data.

Ending the contract
The contract may be terminated on one month’s notice. We may block an account immediately if the way the app is being used threatens the data of other institutions — we give the reason in writing.

Cookies on the site
The product site uses a visitor counter which sets cookies and does not start until you consent on the bar shown on the first visit. Refusing limits nothing — neither on the site nor in the programme. The details, the file names and how to withdraw consent are described in the privacy policy.
The programme itself has no counter. It does store data in the device’s memory, because without that it would not work out of signal range — that too is described in the privacy policy.

Governing law and disputes
Polish law applies. Disputes are settled by the court having jurisdiction under the general rules — we do not name a court convenient to ourselves.
